The case was lodged against unknown for committing dacoity in a train. The name of petitioner No.1, Radhe Das, figured in the confessional statement of petitioner No.2, Lalchand Das @ Lalchan Das. Later on co-accused Chhedi Das @ Raj Kumar Das also disclosed the name of petitioner No.1 but no recovery was made. Except the confession there appears no evidence to show involvement of the petitioners. Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named
