This application, for grant of regular bail, arises out of Buxar (Town) Police Station Case No. 46 of 2021, disclosing offences under Section 21/22/27 of the N.D.P.S. Act. The learned counsel for the petitioner submits that the petitioner is in custody since 21.01.2021 and is a person with clean antecedent and charge-sheet has been submitted. The learned counsel for the petitioner submits that the allegation is of recovery of 06 gram heroin like material from the possession of the petitioner which even included the weight of the paper. The learned counsel further submits that small quantity of heroin is 5 gram while commercial quantity is

Considering the fact that the petitioner is in custody since 21.01.2021 is a person of clean antecedent and chargesheet has been submitted and recovery is little more than small quantity, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IX-cum-Special Judge, Buxar, in connection with Buxar (Town) Police Station Case No. 46 of 2021, with a condition that one of the bailor shall be the mother of the petitioner.
