The present appeal has been preferred on behalf of the appellant for setting aside the order dated 09.09.2020 passed by learned Additional Sessions Judge-I-cum-Special Judge, SC/ST (POA) Act, East Champaran at Motihari, whereby the appellant's prayer for bail, in connection with Ghorasahan (Jitna) P.S. Case No. 287 of 2020, registered for the offences punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code and Section 3(i)(r)(s) of the SC/ST
Patna High Court CR. APP (SJ) No.2070 of 2020(2) dt.20-02-2021 2/3 (Prevention of Atrocities) Act, has been rejected. Accusation is that in the morning of 18.07.2020, informant Vidya Sagar Baitha was returning from field to his house, in the way at pond a meeting was going on in respect to fishing out from the pond, where he was also called and some villagers told that presence of Baitha/Dhobi is a good sign and asked to select the informant Vidya Sagar Baitha as a member, but in the meantime, Ravindra Singh (Appellant) started to abuse to informant Vidya Sagar Baitha denoting his caste. When informant made protest then appellant Ravindra Singh gave Fatha blow at his head causing blood oozing injury and Ravi Shankar Singh, son of Ravindra Singh also caused injury to him.
Learned counsel appearing on behalf of appellant submits that the injuries, which is said to be caused by the appellant at the head of informant Vidya Sagar Baitha is of simple in nature. Further submission is that the appellant has falsely been implicated in this case due to dirty village politics. Further submission is that while the appellant is accused in four cases, as detailed in paragraph No.3, but he is on bail in that cases.
Having regard to the facts and circumstances of the
Patna High Court CR. APP (SJ) No.2070 of 2020(2) dt.20-02-2021 3/3 case, let the above named appellants, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-I-cum-Special Judge, SC/ST (POA) Act, East Champaran, Motihari in connection with Ghorasahan (Jitna) P.S. Case No. 287 of 2020.
Accordingly, the impugned order is set aside and appeal is allowed.
