JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is languishing in custody since 08.01.2015 in connection with Bettiah Mufassil (Banuchapar) P.S. Case No. 547 of 2014 for the offences instituted under Sections 302 and 201/34 of the I.P.C.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 30.12.2014 after receiving information by the informant that his brother's dead body was lying at cremation place, he alongwith his family members went there and identified the dead body being his younger brother Chunnu Ram. He further stated that on 21.12.2014, a quarrel has taken place with Akhilesh Ram and Madan Ram over some issue. Thereafter, he informed the local
Patna High Court Cr.Misc. No.25968 of 2015 (2) dt.23-07-2015 2/2 police and inquest report of the deceased has been prepared. He also suspected that F.I.R. named accused persons including the petitioner have killed his brother and put the dead body on fire in order to hide the same.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.01.2015 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner had got no criminal antecedent. As per allegation, only a suspicion is said to have been raised against the petitioner and except for that, there is no direct or indirect evidence against the petitioner.
On behalf of the State and the informant it has been submitted that the petitioner is named in the F.I.R. and the petitioner is directly involved in the present case. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah, in connection with Bettiah Mufassil (Banuchapar) P.S. Case No. 547 of 2014.
