JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-07-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 307, 379, 384, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

There is allegation against the persons named in the FIR, 12 in number that they vandalized cars of the brother-inlaw of the informant. It is alleged that nearly 150-200 persons had come to the place of occurrence, which is house of the brother-in-law of the informant and they were chasing for his brother-in-law and for the same occurrence another case has

It is submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioners. It is also submitted that there is case and counter case in between the parties. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc.No.26094 of 2019 vide order dated 22.04.2019.

Considering the nature of accusation and the fact that similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya/successor Court in connection with Bodh Gaya P.S.Case No.706 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds
