JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 414 of the Indian Penal Code.

Petitioner is said to have been caught on the spot while he along with two others made attempt to commit loot but submission on behalf of the petitioner is that no such occurrence, as alleged in the first information report, did ever take place and as a matter of fact, some altercation took place between petitioner and informant and after that informant handed over the petitioner to police with concocted story. Moreover, petitioner is in jail custody since 28.02.2016 and does not have any criminal

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Mirganj P.S. Case No. 59 of 2016.
