JUSTICE PARTHA SARTHY ORAL ORDER 23-12-2020 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Charpokhari P.S. Case No. 136 of 2019 registered under sections 8, 20(B)(II)(c) and 27 of the NDPS Act.

A total of 34.3 kg. Ganja was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that while rejecting his application for bail by order dated 16.3.2020 (Annexure-2) this Court had granted liberty to this petitioner to renew his prayer for bail after six months. It has been more than nine months since the date of rejection on 16.3.2020.

No.35035 of 2020(2) dt.23-12-2020 2/2 Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the liberty granted by the aforesaid order dated 16.3.2020 (Annexure-2), the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Charpokhari P.S. Case No. 136 of 2019 on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Bhojpur at Ara.
