JUSTICE RAVI RANJAN ORAL ORDER 12-05-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
It is contended that improbable story has been made in the FIR according to which, one Shiv Paswan threw dust upon the deceased and, in the next morning, i.e., on 12.12.2015 there was some altercation with the petitioner for that reason in which the petitioner along with two others assaulted him with lathi danda, however, no FIR was lodged and when death occurred on 14.12.2015, the FIR was lodged. It is further contended that the deceased was blind, he might have received injuries in some other manner due to which he succumbed to the injuries but the
Patna High Court Cr.Misc. No.18664 of 2016 (2) dt.12-05-2016 2/2 petitioner has falsely been implicated in this case. It is thus contended that there is general and omnibus allegation against three persons including the petitioner.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Sujeet Paswan be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Karpi (Sahar Telpa) P.S. Case No.213/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
