JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State.

The petitioner is in custody in a case registered under Sections 399, 400, 402 of the Indian Penal Code, 25 (1-B) A/26/35 of the Arms Act and Sections 4 and 5 of the Explosives Substance Act.

The prosecution case, in brief, is that on 16.12.2014 the O.C. of Ujiyarpur P.S. has submitted a written report before the learned S.D.J.M., Dalsinghsarai, Samastipur stating therein in the night of 14-15 of December, 2014 while he was on patrolling duty he received secret information that some miscreants have assembled in the house of one Satyanand Giri at Village Akha Rathpur. Thereafter, he along with the police personnel went to the

No.25290 of 2015 (2) dt.21-07-2015 house of said Satyanand Giri and from there 7-8 persons were apprehended by the police and recovered various arms including country made loaded pistols and large number of cartridges, country made bombs and mobiles from their possession. The accused persons have confessed before the police that they were planning to commit dacoity in Gramin Bank, Raipur. On the aforesaid information Ujiyarpur P.S. Case No. 197 of 2014 has been instituted.

It is submitted on behalf of the petitioner that the petitioner is in custody since 16.12.2014. As per FIR it is alleged that one country made pistol and four live cartridges are said to have been recovered from the possession of the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur in connection with Ujiyarpur P.S. Case No. 197 of 2014.
