1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners at the outset seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.2, Rupesh Yadav @ Rupesh Manjhi @ Santosh Kumar, who was arrested during pendency of the instant anticipatory bail application.

3. Permission is accorded.

4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.2, Rupesh Yadav @ Rupesh Manjhi @ Santosh Kumar.

5. The petitioner no.1 seeks bail in anticipation of his

Patna High Court CR. MISC. No.36932 of 2026(2) dt.15-06-2026 2/3 arrest in a case registered for the offences punishable under Sections 189(2), 126(2), 115(2), 132, 292, 303(2), 223 of the B.N.S.

The learned counsel for the petitioner submits that the petitioner no.1 is a person with clean antecedent and the informant alleges that he received an information that Shambhu is loading sand illegally on his red colour tractor from Kairi River, accordingly he reached the place of occurrence and saw Shambhu loading sand but on seeing the police force Shambhu unloaded the sand and fled leaving the tractor. Further, he called his villagers who came and took away the tractor and even acted inappropriately with the police force.

7. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that thrust of the allegation is against Shambu. It is also submitted that even tractor was not seized. It is further submitted that petitioner being a co-villager of Shambu came to be implicated along with others based on the disclosure made by the Chaukidar. It is further submitted that petitioner resides nearby the place of occurrence, as such, when ruckus was created, he also came to

It is reiterated and submitted that petitioner is a person with clean antecedent. It is further submitted that even allegation against the petitioner is general and omnibus in nature.

8. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no.1, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Baunsi P. S. Case No.123 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
