JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section379 of the Indian Penal Code. Some unknown persons are said to have snatched the gold chain of the informant and accordingly, the first information report was lodged against unknown persons. The name of this petitioner surfaced in this case on the basis of confidential information, given by spy of the police and, thereafter, one coaccused Deepak was arrested and confessed his guilt, disclosing the name of the petitioner. It appears that except the above-said two circumstances, there is nothing against the petitioner except

Patna High Court Cr.Misc. No.18976 of 2016 (2) dt.05-05-2016 2/2 the criminal history of the petitioner. The investigation against the petitioner has already been completed.

Considering the nature of material, collected by the investigating officer to show the involvement of the petitioner in the alleged crime as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patliputra P.S. Case No. 156 of 2015 to the satisfaction of Smt. Aaditi Gupta, learned Judicial Magistrate-Ist Class, Patna.
