The petitioner is accused in connection with Bhorey P.S. Case No. 133 of 2015, registered under Sections 420, 467, 468, 487, 491 and 504 of the Indian Penal Code. The accusation is that petitioner Santosh Kumar Mishra, Sarvesh Kumar Mishra, Rajnarayan Sharma and Rajkishore Sharma created two non-banking company i.e. (1) Ambition Infratech Limited and (2) Ambition Infra Tower Limited and started publicity of both companies for depositing the money by the people to get good return. Initially, small amount were returned to the customers, thereafter, the company was closed as such several people were cheated by the company and its officials.

No.19960 of 2016 (3) dt.15-07-2016 2/2 Learned counsel for the petitioner submits that petitioner was agent of the said company, which fact come in paragraph 39 of the case diary as such petitioner is simply a commission agent of the company and not the director of the company. Further submission is that petitioner having no criminal antecedent is in custody since 20.03.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Gopalganj in connection with Bhorey P.S. Case No. 133 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
