The petitioner is an accused in a case registered under Sections 409, 379 and 34 of the Indian Penal Code. Accusation is that the petitioner being In-charge Headmaster of Middle School of Bashi Anupama Kumri was apprehended by the villagers with Thela at Bashai Chowk which was being carried by Vikash Paswan loaded with five bags of rice of Midday meal of the school for selling in the market. Learned counsel for the petitioner submits that, in fact, five bags of rice were being sent at Mill for cleaning but due to ulterior motive at the instance of the iformant, the petitioner has been falsely implicated in the present case.
