JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Nardiganj P.S.Case No. 67 of 2015 registered under Sections 147, 148, 149, 341, 307, 379, 504 and 120B of the Indian Penal Code and 27 of Arms Act, pending in the Court of learned C.J.M., Nawadah.
Accusation is that in course of quarreling regarding construction of drain this petitioner fired at the abdomen of Ranjit Kumar, brother of the informant.
Learned counsel appearing on behalf of the petitioner submits that from perusal of FIR it appears that there is specific allegation against Rabindra Singh, who fired upon the
Patna High Court Cr.Misc. No.19691 of 2016 (2) dt.11-05-2016 2/2 neck of Navin, the other brother of the informant but the police has submitted final form against him. Further submission is that due to land dispute the petitioner has falsely been implicated in the present case.
There is specific allegation against the petitioner causing fire arm injuries at the abdomen of Ranjit Kumar, the brother of the informant. Two fire arm injuries, grievous in nature, were found at the abdomen of the victim. Having considered the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail and same is rejected.
