JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard the learned counsel for the petitioner as well as the learned for the State.

The petitioner is languishing in custody since 27.03.2015 in a case registered for the offences punishable under sections 20/22 of the N.D.P.S. Act.

On an information that the trade of ganja is going on the police conducted a raid and from possession of the petitioner 7.5 kg. of ganja was recovered.

It is submitted by learned counsel for the petitioner that mere on suspicion the petitioner has been apprehended. A statement has been made in para-3 of the petition that the petitioner has no criminal antecedent.

No.25614 of 2015 (2) dt.27-07-2015 2/2 Considering the fact that the investigation has already been concluded and the recovery of ganja is between small and commercial quantity, moreover the petitioner has no criminal antecedent, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, N.D.P.S. Act, Darbhanga in Kusheshwar Asthan P.S. Case No. 107 of 2015.
