2. The petitioners apprehend their arrest in connection with Khanpur P.S. Case No. 249/ 2025 registered for the offence(s) punishable under Section(s) 126(2), 127(2), 303(2), 308(2), 308(3), 352, 351(2) read with section 3(5) of the BNS.
3. Learned counsel for the petitioners submits that on the alleged date and time of the occurrence, the Assembly Election was being held and the petitioners were supporters of a particular political party and due to political enmity, they have been falsely implicated at the instance of the opposite party. It is further submitted that in the entire FIR, there is no specific allegation against the petitioners and during the course of investigation, the independent witnesses did not support the allegations made in the FIR and they simply stated that on the
Patna High Court CR. MISC. No.34791 of 2026(3) dt.15-07-2026 2/2 alleged date and time of the occurrence, a scuffle and exchange of abuses took place in between members of two different political groups. It is lastly submitted that both the petitioners have no criminal antecedent.
4. Learned APP appearing for the State has opposed the prayer of the petitioners.

Considering the aforesaid submissions advanced by the petitioners' counsel and taking note of the petitioners' role in the commission of the alleged occurrence, in my opinion, the petitioners deserve to the relief of anticipatory bail. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Khanpur P.S. Case No. 249/ 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the BNSS.
