Petitioner is accused in connection with S. Tr. No. 879 of 2012 arising out of Ram Krishna Nagar P.S. Case No.45 of 2012 registered under Sections 341, 323, 326, 307, 498A and 304 of the I.P.C.
Learned counsel for the petitioner submits that petitioner, who is husband of the deceased, is in custody since 09.04.2012 and his prayer for bail was been rejected vide order dated 19.03.2014 with direction to the trial court to expedite the trial as early as possible, but up-till-now, the trial is pending for prosecution evidence.
On perusal of the report, as received from the Court
Patna High Court Cr.Misc. No.21382 of 2016 (3) dt.03-08-2016 2/2 of Additional District and Sessions Judge-III, Patna through Letter No. 152 dated 25.05.2016, it is revealed that out of 9 witnesses, only 3 witnesses have been examined by the prosecution. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Adhoc Additional Sessions Judge, Patna in connection with Sessions Trial No. 879 of 2012 arising out of Ram Krishna Nagar P.S. Case No. 45 of 2012.
