The petitioner seeks bail in anticipation of his arrest in connection with C-III Case No. 36 of 2020 dated 12.02.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Though the petitioner has not been arrested from the spot but the recovery of the liquor is from the motor-cycle belonging to the petitioner.

Patna High Court CR. MISC. No.32434 of 2020(2) dt.12-02-2021 2/2 Considering this aspect of the matter, I am not inclined to grant anticipatory bail to the petitioner. The prayer for bail of the petitioner is rejected. However, if the petitioner surrenders before the court below and seeks bail, his petition shall be considered on its own merits, without being prejudiced by the fact that the present petition has not been entertained by this Court.
