JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section and other ancillary sections of the Indian Penal Code.

As per the prosecution case, while the informant and his staff were returning to the home from the shop, four motorcycle borne unknown miscreants intercepted them and snatched Rs.5 lacs and the motorcycle from the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not been carried out till date. Petitioner's name has figured during course of investigation in confessional statement

Patna High Court CR. MISC. No.44424 of 2021(2) dt.02-11-2021 2/2 of co-accused Sujit Kumar. Petitioner has claimed clean antecedent and he is in custody since 6.4.2020. Charge sheet has already been submitted.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur in Raghopur Police Station Case No. 107 of 2020/GR No. 350 of 2020.
