The petitioner wants to renew his prayer of bail which was earlier rejected by order dated 02.11.2015 passed in Criminal Miscellaneous No. 26613 of 2015 on the ground that during trial, the informant victim has not named the petitioner that he committed rape with her. She has been examined as P.W. 4 in Sessions Trial No. 440 of 2015 vide annexure-3 series and further, the husband of the informant has also not named the petitioner.
In the changed circumstances, now, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.19801 of 2016 (2) dt.04-05-2016 2/2 amount each to the satisfaction of the learned Additional District Judge, 1st, Sasaram (Rohtas) in connection with S.T. No. 440/15 arising out of Nokha P.S. Case No. 136 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
