The petitioner seeks bail in connection with Bind P.S. Case No. 126 of 2019, dated 16.09.2019, instituted for the offences under Sections 147, 149, 323, 341, 302, 307, 504, 506 and 509 of the Indian Penal Code.

Patna High Court CR. MISC. No.32423 of 2020(3) dt.27-01-2021 2/3 It has been alleged in the First Information Report that the petitioner and few others were looking for the deceased. Later, it has been stated that when the deceased was located, three persons, viz., Rajiv Ranjan Kumar, Chandra Shekhar Kumar and Prem Kumar assaulted him by lathi-danda etc., leading to his death.

Learned counsel for the petitioner has submitted that the accusation against him is only of having accompanied few persons to the house of the deceased to look for him. So far as the assault is concerned, nothing specific has been attributed against the petitioner. Apart form this, it has been submitted that there is past enmity between the parties and that the petitioner is in custody since 18.03.2020.

Regard being had to the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two
