The petitioner being the husband of the complainant is languishing in custody since 19.02.2016 in a case registered for the offences punishable under sections 498A of the Indian Penal Code and 4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant. Though, the complainant has performed second marriage with one Prakash Sah but the petitioner is still ready to keep the complainant as wife with dignity and honour. Statement to that effect has been made in paragraph 8 of the petition, which reads
Patna High Court Cr.Misc. No.22452 of 2016 (2) dt.19-05-2016 2/2 as follows :- "That the petitioner is still having love with his wife and ready to kept her with full dignity and honour and wife...."
It is further submitted that the petitioner has filed Matrimonial Suit No.105/2008 for restitution of conjugal life wherein the complainant is not appearing.
Considering the nature of accusation and the present stand of the petitioner, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria, in connection with Complaint Case No.1018C/2008.
