JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and 25(1-b)a, 26/35 of the Arms Act and 3⁄4 of the Explosive Substance Act. Petitioner was arrested along with several others and one loaded country made pistol and three live cartridges are said to have been recovered from his conscious possession and it is alleged that petitioner and his associates were making preparation to commit dacoity. Petitioner was earlier made accused in two cases which was registered in the year 2003 and 2011 respectively. Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is in jail custody

Patna High Court Cr.Misc. No.20016 of 2016 (2) dt.06-05-2016 2/2 since 21.11.2015, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Purnia in connection with Daguruwa P.S.
