JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code and 27 of the Arms Act.

The petitioner is named in the First Information Report on the accusation that he took the deceased from his house but it is specific case of prosecution that co-accused Jay Kumar Bharti shot fire on the deceased as a result of which the deceased died.

Considering the aforesaid facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the petitioner is in jail custody since 13.12.2015

Patna High Court Cr.Misc. No.20636 of 2016 (2) dt.19-05-2016 and except allegation of conspiracy, there appears to be nothing against him, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Saharsa in connection with Salkhua (Banma Itahari O.P.) P.S. Case No. 259 of 2015.
