The petitioner is languishing in custody since 05.06.2015 in connection with Sarai P.S. Case No. 226 of 2012 for the offences instituted under Sections 341, 323 and 302/34 of the IPC. The prosecution story, in brief, is that the petitioner alongwith his wife Naga Devi brutally assaulted the father of the informant with danda of Bamboo and Fatta and due to which injury was caused on head, back and body and on 13.12.2012 the blood started oozing from the nose and mouth of the informant's father Kishun Manjhi and in the night at 2.00 A.M. his father has died. The informant has claimed that due to assault by the
Patna High Court Cr.Misc. No.17589 of 2016 (3) dt.24-05-2016 2/2 petitioner and co-accused Naga Devi death of his father was occurred.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 05.06.2015 and the charge sheet has been submitted in the present case. The occurrence has taken place due to a petty reason which led to institution of the present case. General and omnibus allegation has been made against the petitioner. There is no allegation of tempering of evidence against the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Sarai P.S.
