The petitioner seeks bail in a case registered under Sections 341, 323, 325, 307/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner assaulted the informant by butt of the gun, due to which he sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to village politics. The allegation is of assault by the butt of the gun. The gun is not said to have been fired in course of

Patna High Court CR. MISC. No.33966 of 2019(3) dt.01-07-2019 2/2 occurrence. Hence, no offence under Section 307 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, Patna in connection with S.T. No.1141 of 2009 arising out of Dhanarua P.S. case No.83 of 1999.
