The petitioner apprehends his arrest in connection with Bahadurpur(Fekla O.P.) P.S. Case No. 105/2019 registered for the offence punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) and 38(i)(36) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that though the alleged recoveries have been shown to be made from the house of the petitioner, actually, the same was from near about the house of the petitioner and not from the conscious possession of the petitioner. He further submits that the petitioner is not having any criminal antecedent. Considering the aforementioned facts and

No.33136 of 2019(2) dt.21-05-2019 2/2 circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Vth-cum-Special Judge (Excise Act), Darbhanga, in connection with Bahadurpur(Fekla O.P.) P.S. Case No. 105/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
