The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code. The prosecution case in short is that the bhagina of the informant went along with the accused persons from his house and later his dead body was found.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.9.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. There is no eye witness to the alleged occurrence. The brother of the petitioner was seen lastly

Patna High Court CR. MISC. No.32253 of 2019(2) dt.16-05-2019 2/2 with the victim. The petitioner has been made accused in the present case as being brother of co-accused Ajay Choudhary. Except for this, there is no substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Sasaram in connection with Nokha P.S. Case No. 237 of 2018.
