The petitioner is custody since 19.07.2014 in connection with Daraudha P.S. Case No. 130/2014 registered for the offences punishable under Sections 302/307/34/447 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the present First Information Report but on the basis of the said confession made in a case, referred to paragraph No. 3 of this application, he was remanded in the present case. Learned counsel for the petitioner submits that though he has been in custody in connection with the present case since almost 10 months now he has not been placed on T.I. Parade so that identification could be made.

No.12288 of 2015 (3) dt.27-05-2015 P2/2 Considering the aforementioned facts and the period of custody and that the confessional statement made before the Police has no evidentiary value, let the petitioner Pawan Kumar Pandey be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan in connection with Daraudha P.S.
