JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302, 120-B of the Indian Penal Code. The present case was lodged on 29-12-2015 at 11.00 a.m. whereas; the fardbyan of informant was recorded on the same day at 8.00 a.m. The petitioner and others were arrested in suspicious condition in the intervening night of 28/29-12-2015 and fire-arms were recovered, for which, Ahiyapur P.S. Case No. 1156 of 2015 was registered. In the aforesaid Ahiyapur P.S. Case No. 1156 of 2015, one co-accused, Vivek Singh confessed his guilt, disclosing the involvement of the petitioner and others in the

No.21086 of 2016 (2) dt.20-05-2016 2/2 present case also and it appears that except the aforesaid confessional statement of co-accused, there is nothing against the petitioner who is languishing in jail custody since 30-12-2015 and the investigation against him, appears to have already been completed.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 1155 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
