The petitioner seeks regular bail in connection with Magadh Medical P.S. Case No. 349 of 2022, registered for the offences punishable under Sections 363 and 366 (A) of the Indian Penal Code.

The allegation against the petitioner is that the minor daughter of the informant fled away with him on the pretext of marriage.

Learned counsel for the petitioner submits that petitioner is innocent and the victim girl had herself ran away with the petitioner due to love affairs. In her statement under Section 164 Cr.P.C., she claimed herself as a major and did not

Patna High Court CR. MISC. No.35594 of 2023(2) dt.07-07-2023 2/2 allege any overt act against the petitioner. Petitioner has no criminal antecedent and is in jail custody since 22.12.2022. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, Gaya in connection with Magadh Medical P.S. Case No. 349 of 2022.
