JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-419, 420, 423, 465,467, 468, 471 & 120(B) of the Indian Penal Code.

The accusation against the petitioner is that he got executed a forged power of attorney in respect of lands of one Sri Hare Krishna Kumar. The informant claims that the aforesaid Sri Hare Krishna Kumar had executed a power of attorney in his favour but in spite of that, the petitioner sold the lands of Sri Hare Krishna Kumar.

Learned counsel for the petitioner submits that earlier the petitioner was granted privilege of anticipatory bail by a

No.21524 of 2016 (2) dt.20-05-2016 2/2 coordinate bench of this court but he could not surrender before the court below in time and filed a Criminal Miscellaneous for modification of the order by which, he was granted bail but his modification petition was dismissed and a coordinate bench of this court directed the petitioner to surrender and to pray for regular bail before the court below. It is further submitted that in pursuance of the direction of this court, the petitioner surrendered before the court below on 02-03-2016 and since then, he is languishing in jail custody.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Udakishunganj P.S. Case No. 140 of 2012 to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj, Madhepura.
