The petitioner is accused in connection with Kharik P.S. Case No. 141 of 2015, registered under Section 304(B) and 201/34 of the Indian Penal Code.
The accusation is of killing of daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry and also to dispose of her dead body. Learned counsel for the petitioner submits that admittedly the petitioner is the husband of the deceased. In fact, the quarrel took place in between petitioner and his wife (deceased) Savitri Devi due to that reason, she committed suicide by administering poison, it has also come in paragraph 28, 29, 45, 46, 68, 8485, 86, 87 and 88 of the case diary, which is
Patna High Court Cr.Misc. No.19305 of 2016 (2) dt.05-05-2016 2/2 detailed in the impugned order of the Addl. Sessions Judge-V, Bhagalpur, but due to ulterior motive, the informant, who is the father of the deceased lodged this case with false allegation. Further submission is that Chargesheet has already been submitted against the petitioner. The petitioner is in custody since 10.08.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Naugachia, Bhagalpur in connection with Kharik P.S.
