JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-01-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Bihariganj P.S. Case No. 243 of 2019 registered for the offence punishable under Sections 304 (B), 201 and 34 of the Indian Penal Code.
The petitioners are father-in-law and mother-in-law of the deceased. It is specific case of the petitioners that the marriage of the deceased with their son was solemnized much more beyond seven years of the death of the deceased. The allegation of demand of dowry is superimposition. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.33171 of 2020(4) dt.27-01-2021 2/2 petitioners has submitted that the deceased died a natural death, as she was suffering from some chronic disease on 23.07.2019 and an information in this regard was given to her parents and other family members.
Be that as it may, considering the fact that the petitioners are in custody since 16.05.2020 and the F.I.R. does not disclose the allegation of any specific overt act against them, this application is allowed.
Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Madhepura in Bihariganj P.S. Case No. 243 of 2019.
