JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State and the learned counsel for the informant. The petitioner is in custody in a case registered under Sections 341, 307, 504, 326/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(R)(S) of the S.C./S.T. Act.
The prosecution case, in brief, is that the informant and his brother were irrigating the field. In the meantime, petitioner and others came there and they started to abuse the informant. It is alleged that the petitioner pulled out pistol and shot at the informant which hit at the back of informant and he fell down.
On behalf of the petitioner, it has been submitted that
Patna High Court Cr.Misc. No.26116 of 2015 (2) dt.27-07-2015 2/2 the petitioner has no criminal antecedents and he is in custody since 24.3.2015. It has further been submitted that there is no means of identification in respect to the participation of the petitioner in the alleged occurrence. It is further submitted that the petitioner may be released after completion of eight months in custody i.e., from 24.3.2015.
On behalf of the State and the informant, it has been submitted that the petitioner is named in the F.I.R. and he is alleged to have caused injury upon the victim. Considering the aforesaid facts and the submissions, it is directed that the petitioner, above named, be released on bail after completion of eight months in custody from 24.3.2015 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sheikhpura, in connection with Chewara P.S. Case No.54 of 2014.
