The petitioner seeks bail in S.Tr. No. 370/2018, arising out of Rohtas (Amjhor) P.S. Case No. 158/2018, instituted for offence under Section(s) 302/34 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 27 of Arms Act. In the written report there is specific allegation against this petitioner of causing gun shot injury to his mother, aged about 67 years, by double barrel gun on account of which she died. It is alleged that one double barrel country made pistol was recovered from the house of petitioner. It is further alleged that petitioner used to torture his mother for land and amount of pension.
Report from the court below regarding present stage
Patna High Court CR. MISC. No.32562 of 2019(3) dt.17-07-2019 2/2 of trial has been received, wherein it is mentioned that six witnesses have already been examined and four witnesses are to be examined. Case is pending for evidence.
Considering the fact that there is specific allegation against this petitioner of causing firearm injury to his mother, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected.
The trial court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of copy of order either by fixing the case on day to day basis or by giving short adjournment and send compliance report.
