JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Chhatauni P.S. Case No. 176 of 2020 registered for the offence punishable under Section 379 of the Indian Penal Code, 1860. The petitioner is in custody since 10.06.2020. The occurrence is of 03.06.2020, when the informant's motorcycle was found missing from the place of a public parking. The petitioner's name emerged on the basis of confessional statements of co-accused persons namely Praveen Kumar and Ranjan Kumar.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.33178 of 2020(2) dt.17-12-2020 2/2 has submitted that except for the confessional statements of coaccused persons, there is absolutely no material against the petitioner. It has been stated that the petitioner has no criminal antecedent.

Considering the above submission and the petitioner's custody since 10.06.2020, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Chhatauni P.S. Case No. 176 of 2020.
