JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 10-07-2024 Earlier, vide order dated 18.08.2023 a report was called from from the learned trial court as to whether the sole appellant in the present appeal is alive or dead.
2. In view of the aforesaid, a report has been received from the office of Senior Superintendent of Police, Gaya vide letter dated 980 dated 21.09.2023, wherein it is stated that the sole appellant namely, Mahabir Sao, son of Late Prasad Sao, resident of Pachmahla, P.S. - Khijarsarai, District - Gaya has died in the year 2009 itself.
3. This appeal stands abated in view of Section 394 of the Code of Criminal Procedure with regard to the sole appellant namely, Mahabir Sao and disposed of, accordingly.
4. Let the Trial Court Records be sent to the learned trial court forthwith.
