2. The present petition has been preferred for the following relief(s):

"for issuance of a writ in the nature of Mandamus commanding the respondent authorities to remove the ancestral land of the petitioners from the list of restricted categories of land which

3. A counter-affidavit has been filed and disputes the contention of the petitioner.

Learned counsel for the petitioner submits that in the case of his brother, Kanhaiya Kumar Sinha, he was allowed to execute registered sale deed in the year 2007 in favour of Shri Rama Raman Sharma and this followed the mutation of the land vide Jamabandi No. 2220. The same has been annexed with the supplementary affidavit as Annexure - P/23 and P/24.

5. Learned State counsel submits that all this facts have never been presented before the Collector, East Champaran, Motihari.

Though the facts are there, it has been countered by the State, in view of the specific averment made in the supplementary affidavit regarding his brother, it would be appropriate that the Collector, East Champaran, Motihari take a look in the present case, get report from the revenue authorities and after hearing the parties, it be taken to its logical conclusion

7. With the aforesaid observation, the writ petition stands disposed of.
