The petitioners are languishing in custody since 09.02.2015 in a case registered for the offences punishable under Sections 302, 307, 120B/34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that Murari Singh opened indiscriminate firing on the son of the informant Pankaj when the other son Rahul came to rescue then he was shot at by petitioner no. 1 Govind Singh then it is also alleged that petitioner no. 2 Mukesh Kumar Singh also resorted to fire which did not cause any injury to anyone. Subsequently the son of the informant Pankaj

Patna High Court Cr.Misc. No.25694 of 2015 (2) dt.23-07-2015 2/2 succumbed to the injury.

It is submitted by learned counsel for the petitioners that the accusation of causing injury to the deceased is against co-accused Murari Singh whereas petitioner no. 1 alleged to have caused firearm injury to Rahul whose injury report suggests only lacerated injury caused by hard and blunt substance. The investigation has already concluded.

Considering the fact that the accusation of causing injury to the victim Pankaj is not against the petitioners, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 13 of 2015.
