The petitioner seeks bail in a case registered under Sections 307, 341, 323, 504, 147, 148, 149 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that while the informant was returning from his workshop, in the way, the accused persons started abusing him and dashed on the point of barrel of the rifle. The informant due to fear started fleeing away, then the accused persons fired which hit in the ankle of a lady. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The

Patna High Court CR. MISC. No.32107 of 2019(4) dt.20-06-2019 2/2 petitioner is in custody since 05-04-2019. Charge sheet has already been submitted. There is case and counter case between the parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 110 of 2019.
