Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
Petitioner is in jail custody since 27.03.2016 on the accusation that he gave dagger blow causing injury on the head of informant but submission on behalf of the petitioner is that no injury said to be caused by dagger was found on the head of informant. It is further submitted that no doubt, informant sustained one injury on his head which is said to be grievous in
Patna High Court Cr.Misc. No.19932 of 2016 (2) dt.06-05-2016 2/2 nature but the aforesaid injury has been caused by hard and blunt substance and, therefore, the aforesaid injury is not attributed to the petitioner. Moreover, there is land dispute and serious litigation between the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Gaya in connection with Magadh Medical P.S.
