JUSTICE SUDHIR SINGH ORAL ORDER 12-08-2015 The petitioner is languishing in custody since 20.4.2015 in connection with Bhawanipur P.S. Case No.65 of 2000 for the offences instituted under Sections 147, 148, 149, 323, 307, 302 of the I.P.C. and Section 27 of the Arms Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that there is allegation against 57 F.I.R.named persons including the petitioner along with 80 to 90 unknown miscreants of firing causing death of some persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.4.2015and the charge sheet has been submitted in the present case. General and omnibus
Patna High Court Cr.Misc. No.25941 of 2015 (3) dt.12-08-2015 2/2 allegation has been made against the petitioner. He has been falsely implicated in this case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R. It is further submitted that the present case is of the year 2000 and the petitioner has surrendered in this case on 20.4.2015. As many as seven cases are pending against the petitioner.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. Anyhow the trial court is directed to take all steps to conclude the trial expeditiously preferably within a period of six months from the date of receipt /production of a copy of this order on day to day basis avoiding undue delay and adjournments.
