The petitioner is languishing in custody since 25.01.2015 in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

On commission of dacoity in the house of the informant the FIR was lodged against Jamshed, Sariful, Munna, Tajuddin and 8-10 unknown persons. The petitioner was arrested on suspicion and thereafter he confessed his guilt. It is submitted by learned counsel for the petitioner that neither there is any recovery from the petitioner nor the petitioner has been put on TIP. Statement to that effect has been made in paragraph nos. 7 and 6 of the petition. Moreover, the

Patna High Court Cr.Misc. No.25698 of 2015 (2) dt.23-07-2015 2/2 investigation has already concluded.

Considering the fact that the petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Belsand P.S. Case No. 159 of 2014.
