The petitioner has filed the instant application for grant of regular bail in connection with Buniyadganj P.S. Case no. 129 of 2019 registered under sections 363 and 365 of the Indian Penal Code to which sections 302, 201, 120B and 34 of the I.P.C. was added subsequently.
As per allegation in the F.I.R., it is stated by the informant that his daughter accompanied by his wife had gone to the market. Later in the evening he received a phone call that his wife had been kidnapped. As such, the F.I.R. was lodged. It is submitted by learned counsel for the petitioner that the petitioner happens to be the informant of the instant case. Subsequently, in course of investigation co-accused Chinta Devi was caught and she confessed before the police. In her
Patna High Court CR. MISC. No.32910 of 2020(4) dt.10-02-2021 2/2 confessional statement she stated that she had given effect to the occurrence with the informant himself who had participated in the occurrence. It is submitted by learned counsel that the so called confessional statement has been made before the police and the said co-accused Chinta Devi has been enlarged on bail vide order dated 1.6.2020 passed in Cr. Misc. No.10005 of 2020. The petitioner is in custody since 24.7.2019 and has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the grant of bail to co-accused Chinta Devi, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Buniyadganj P.S. Case no. 129 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- VIII, Gaya.
