The petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. The prosecution case is that when the wife of the informant called her daughter, her daughter's mobile was switch off then she called her son-in-law. Some one else received the call and said that her daughter has been killed, then the informant along with others came to her daughter's house and found that his daughter has died. The dead body was made to stand with the wall. The nearby persons told him that she has been killed after beating. Thereafter the informant informed that Janipur police station which came there and sent the dead body for postmortem. The deceased had two children and was also

Patna High Court CR. MISC. No.33454 of 2019(3) dt.30-08-2019 2/2 pregnant. The informant alleges that his son-in-law had illicit relation with his daughter-in-law due to which he killed his wife.

It has been submitted on behalf of the petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the present case. The petitioner is in judicial custody since 19.12.2018. The learned counsel for the petitioner further submits that the deceased had a three years old and a two years old boy and was also pregnant which shows that the had good and cordial relation with the petitioner. Considering the fact that the petitioner is the husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Phulwarisharif (Janipur) P.S. Case No. 1033 of 2018 pending before the court of the learned Additional Sessions Judge-XV, Patna.

Accordingly, the application is dismissed. However, the trial court is directed to conclude the trial within 16 months. (Anjani Kumar Sharan, J) devendra/- U T
