The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

As per allegation in the FIR, several accused persons including the petitioner armed with various weapons and coaccused Pankaj Choudhary started to abuse the informant's husband. On protest, Pankaj Chaudhary started to assault by spade on his head and co-accused Banti has assaulted him by means of iron rod over his different parts of body. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Specific

Patna High Court CR. MISC. No.35565 of 2023(2) dt.26-06-2023 2/2 allegation of assault is against co-accused Pankaj Chaudhary and Bunti and not against the petitioner. He was only a member of the mob. As per injury report, annexed as Annexure-2, injured has received total three injuries out of which two are simple in nature and one is grievous caused by hard and blunt substance. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 5.4.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Neemachandpur P.S. Case No. 30 of 2023.
