Petitioners apprehend arrest in a case registered for the offence punishable under Sections 323, 305, 379, 504/34 and other sections of Indian Penal Code.

As per prosecution case, all the FIR named persons including these petitioners assaulted the informant and his family members with lathi.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. On account of land dispute between the parties the alleged occurrence took place in which informant

Patna High Court CR. MISC. No.35351 of 2022(2) dt.02-11-2022 2/2 and his family members sustained simple injury. Petitioners have got clean antecedent.

Learned counsel for the informant vehemently opposes the bail application.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Gaya in Konch P. S. Case No. 301 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
