Learned counsel at the outset seeks permission to withdraw the present anticipatory bail application as it has been submitted that earlier petitioner had filed Criminal Miscellaneous No. 24526 of 2021 which stood dismissed for default by order dated 24.03.2022 passed by the Hon'ble Coordinate Bench.

Learned counsel submits that a restoration application ought to have been filed but it appears that under wrong advice the present anticipatory bail application came to be filed. Thus, seeks permission to withdraw the present anticipatory bail application.

Patna High Court CR. MISC. No.35225 of 2022(3) dt.16-11-2022 2/2 Permission is accorded with liberty to the petitioner to file a restoration application.

Accordingly, the present anticipatory bail application stands dismissed as withdrawn.
