The petitioners seek bail in connection with Mohammadpur P.S. Case No. 173 of 2020, dated 16.08.2020, instituted for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Patna High Court CR. MISC. No.33404 of 2020(2) dt.14-12-2020 2/2 Petitioner No. 1 is the driver of the vehicle and petitioner No. 2 is a passenger on the said vehicle from where 997.500 litres of foreign liquor is said to have been recovery.

Learned counsel for the petitioners has submitted that both the petitioners were absolutely unaware that liquor was loaded in the vehicle.

The petitioners are in custody since 17.08.2020 and are persons of clean antecedents.

Regard being had to the nature of accusation and the period of custody of the petitioners, they are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-Cum-Special Judge, Excise, Gopalganj in connection with Mohammadpur P.S. Case No. 173 of 2020.
